Does a Propane Company in New York Need a Written DOT Hazmat Security Plan?

Use your transport work to decide if the federal plan applies. Then check which fire code covers each New York site. The 2025 Fire Code of New York State took effect December 31, 2025. New York City has its own fire code. Put the right code in each site file.

Name the enforcing office for each location

Local governments usually run and enforce the Uniform Code. The state has arrangements for a government that opts out. Find the real enforcing office for your address. You can add its code official to the site's operating contacts.

For sites under the state fire code, chapter 80 lists NFPA 58–2024. Keep that edition with chapter 61 and the right amendments. The site standard does not decide whether the federal transport plan applies.

Match access planning to the actual installation documents

Section 6101.3 requires construction documents for a container over 2,000 gallons of water. It also covers tank setups over 4,000 gallons of water in total. Get the right approved site details from the project owner. Use them when describing delivery access and filling areas.

Section 6101.2 bars filling where an installation permit is required until that permit is issued. That condition matters. It does not mean every propane site needs the same permit. Ask the enforcing office what applies. Tell dispatch about any delivery hold.

Connect filling-area controls to the security review

Chapter 61 requires qualified attendants for transfer work. It bars tampering with required safety devices. For your site review, ask who can conduct transfers. Show how staff report a damaged or altered device. Those assignments do not replace the federal risk review.

Read the national plan page for the federal amount trigger. It also covers staff, access and risks en route. The New York manual guide covers code references and installation records.

Questions for a New York branch manager

Can our NYC site use the state checklist without an FDNY review? New York City has its own Fire Code. Check the city provisions and responsible office for that site.

Does DOS normally issue each town's installation approval? DOS describes local administration and enforcement. Arrangements apply when a government opts out. Find the enforcing office for the address.

Which NFPA 58 edition does the 2025 state code list? Chapter 80 lists the 2024 edition. Use it with the state LP-gas rules and right local rules.

Can we fill before a required installation permit arrives? Section 6101.2 bars filling until that permit has been issued. It applies where the permit is required.
